Traduction française en préparation — version anglaise (Steinsaltz) : MISHNA: Partners who vowed not to derive benefit from one another are prohibited from entering into a courtyard that they jointly own, since each one has a portion in it and benefits from the share owned by the other, thereby leading to a violation of the vow. Rabbi Eliezer ben Ya’akov says: It is permitted for both to use the courtyard, as it can be said that since each has a portion in the courtyard; this one enters into his own portion and that one enters into his own portion.

הַשּׁוּתָּפִין שֶׁנָּדְרוּ הֲנָאָה זֶה מִזֶּה — אֲסוּרִין לִיכָּנֵס לֶחָצֵר. רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: זֶה נִכְנָס לְתוֹךְ שֶׁלּוֹ, וְזֶה נִכְנָס לְתוֹךְ שֶׁלּוֹ.(משנה)

מתני' השותפין שנדרו הנאה זה מזה - מפרש בגמ' אי בנדרו אי בהדירו מיירי:,אסורים ליכנס לחצר - בחצר של שניהן דכל חד אסור בדריסת הרגל של חבירו וקא סבר אין ברירה דאימור האי לחלק חבירו עייל והאי לחלק חבירו עייל:,ר"א בן יעקב אומר זה נכנס כו' - דקסבר יש ברירה:

מתני' השותפין אסורין ליכנס בחצר - דאדריסה קפדי ובפרק חזקת הבתים (בבא בתרא דף נז:) מוקמינן ליה כרבי אליזר דאמר דויתור אסור במודר הנאה: ,רבי אליעזר ב"י אמר זה מהלך בתוך שלו - דסבר דיש ברירה והאי בדידיה קמהלך והאי בדידיה קמהלך והכי מפרש בפרק שור שנגח את הפרה ומיהו ודאי אסור ליה לשטוח פירות בכל החצר אבל להלך בכולו מותר דאמר בכל דוכתא דקמהלך היינו חלקו:
